On June 14, 2012 the NOP published "NOP 2604 Changing ACAs Internal Rev04" which describes procedures for organic operations changing certifying agents. Following these procedures will facilitate a smooth transition to a new accredited certifying agent, which is vital to maintaining organic integrity.
The instructions state, "Certification under USDA organic regulations is not transferrable between certifying agents. Certifying agents may not sell or otherwise transfer certified operation files or certificates to another certifying agent."
And, "…in all situations where a certified operation wishes to change from their existing certifying agent to a new certifying agent, the certified operation must complete an application and submit a complete organic system plan (OSP) to the new certifying agent. These requirements apply whether the change of certifying agent is a result of a business decision or the result of the current certifier losing or surrendering its accreditation."
On June 14, 2012 the NOP published "2605 Reinstating Suspended Ops Rev07" which provides instructions for suspended operations requesting reinstatement. These procedures will help both certifying agents and certified operations demonstrate compliance with the USDA organic regulations.
The updated instructions state, "the NOP Deputy Administrator has been delegated the responsibility to act on behalf of the Secretary with regards to reviewing and approving requests for reinstatement of certified organic operations."
"Once an organic producer or handler’s organic certification has been suspended for any reason, including nonpayment of fees, eligibility for certification must be reinstated by the NOP. Certifying agents cannot reinstate certification of any producer or handler without NOP review and written approval. Suspended operations must submit a written request for reinstatement as described in the regulations."
